IINFORMATION CONCERNING VISA OR LONG-TERM STAY PERMISSION FOR THE PURPOSE OF EMPLOYMENT
Besides the work permit, the foreigner who intends to work in the CR must also obtain a valid visa for over 90 days for the purpose of employment or the permission for a long-term stay for the purpose of employment.
The foreigner files the application for the visa for over 90 days through the Czech Visa Application Form in person at the CR embassy. Where applicable, the CR embassy may not insist on the personal filing of the application.
In exceptional cases, the foreigner may file the application from within the territory of the CR, and namely under the following conditions:
- the foreigner submits the application during his/her stay within the territory of the CR based on a visa for over 90 days issued for the purpose of family reunion covering a spouse, minor child or major dependent child, and applies for a visa for another purpose,
- the foreigner submits the application during his/her stay within the territory of the CR based on a visa for over 90 days, and applies for the visa for the purpose of family reunion covering a spouse, minor child or major dependent child,
- the visa should be granted to a minor or major dependent foreigner for the purpose of reunion with his statutory representative staying within the territory of the CR on the basis of a long-term residence permit or permanent residence permit or visa for over 90 days or on Czech citizenship.
The application for the long-term stay for the purpose of employment shall be filed by the foreigner in person at the CR embassy or the respective Foreign Police department with local jurisdiction over the area of his/her residence in the CR.
Time to handle the application is 120 days starting the day it has been filed.
The foreigner shall submit the following documents together with the application:
- travel document
- document confirming the purpose of his/her stay in the CR (if employment is the purpose of the stay, he/she must produce the work permit or the reference number under which his/her application for the work permit has been registered)
- document confirming the provision of accommodation during his/her stay in the CR
- copy of an entry in the criminal records of the CR for the assessment of his/her qualification due to criminal records; this requirement does not apply in cases of aliens under the age of 15 years
- 2 photographs
- document confirming possession of funds to cover the stay in the CR (under Section 13 of the Act no. 326/1999 Coll., on Residence of Aliens in the Territory of the Czech Republic) need not be submitted by the foreigner if employment is the purpose of the stay
The duty to present a copy of an entry in the criminal records of the CR is considered discharged if the foreigner files an application for this copy to the Czech Embassy when filing the application for visa, and agrees for the copy to be sent to the respective Foreign Police department in the CR.
When applying for the visa for over 90 days, the foreigner is obligated to submit upon request:
- a document similar to the copy of an entry in the criminal records of the CR issued by his/her home country as well as the countries where the foreigner stayed for a continuous period of over 6 months during the last three years as a background document for the assessment of his/her qualification related to criminal records. Such document may be substituted by an affirmation in case the country in question does not issue similar documents; the requirement does not apply to foreigners under the age 15 nor to foreigners filing their application for visa to the police department in the CR during their stay within the territory of the CR based on a visa for over 90 days.
- in specific cases foreigners submit a medical record confirming that the they do not suffer from any „grave illness“ listed in the decree of the Ministry of Health of the CR no. 274/2004 Coll., determining the list of illnesses which could endanger public health and public order.
- All the attachments to the application for visa may be no older than 180 days, except the travel document, birth and status documents and photographs of the foreigner, if corresponding to his/her actual appearance.
- All documents in foreign languages shall be subject to superlegalization at the CR embassy or accompanied by an apostil, if not provided otherwise in valid bilateral international agreement, and shall be officially translated into the Czech language by a certified translator.
